My daughter is living with me now should I stop paying child support? I've been paying child support for 2 children. I had my son last year ,and he went to school, he was a junior, then he didnt want to obey myrules so he went back to his mom, and he got into trouble with the law, now he is charges with a felonyof 10,000,00. should I still need to pay for him. And now my daughter has come to live with me, because she also got into trouble with the law , she hit an officer.she is 16yrs. old ,she wants to change her life.And finish school where I am at.She has been at boot camp and at San Marcus Tx. I feel that my kids havent been brought up right. My daughter says her mother is always running them out of the house.And they also raise the hand to her. My ex-doesnt want me to have my kids ,because then she wont get any more money. I think children should be loved and not taken as an advantage. Please write to me back. |

If the child support you pay is mandated by the court, then you can not stop paying it unless you get the court to change it's decission.
Even if your children live with you or not, the court must give you permission to stop making the payments. Otherwise you could end up in jail for not paying.
Go to family court and file paperwork for a hearing. Explain to the court your situation, and ask if you can stop paying. You never know, since your daughter is living with you now, the mother may end up paying you child support.
It sounds as though your children are on the wrong path. It is commendable that you love your children and want to help them, but also realize that sometimes they need a hug, and other times they need a swift kick in the ass.
Hitting an officer and stealing $10,000 are pretty big crimes for people so young. It is ok to let your children know you love them, but someone needs to lay down the law to them before they end up in prison, dead, or killing someone.

If the one child goes goes to jail for any length of time or the state takes him and makes him an award of the state, you would need to file a petition to stop child support if he /she is in jail, if the child is a ward of the state then you will probary both end up paying the state money for his care. Your daughter if she is residing with you you again also have to file for custody and if the mother is trowing her out then you should file, if the court grants you custody at that time you can ask the court to stop your child support order and ask for support from the mother, you should contact a lawyer if you feel you need additional information.
