Can i obtain custody of my grandchildren while there father is away at boot camp? I am the grandmother of 2 boys one is severly handicaped. 2 years ago i had temporary custody of them when both parent were found to be doing drugs. in the last 1 1/2 years since my son has had custody i have worried about how they were being cared for. he has moved 6 times lived with 2 different women. exactly 4 weeks ago he left to go to boot camp. he left his children here for me to care for while he is gone. I have noticed that there are some things that I am concerned about. can i petetion the courts in virginia to get emergency custody and then permanent custody? the mother is still using cocaine and not allowed to see the children because of it....... |

In this case where the father is in boot camp and has left the children with you then yes i would file for tempory custody while he is gone. The court has already allowed you at one time to have tempory custody and there should be no reason why you should not be allowed to take it again. You could of had the father sign a consent form giving you consent to allow you to file for legal guardianship,that may still be an option. You call try to call him or write and see what he says about this.
